These Terms of Use ("Terms") govern your access to and use of the KaliWealth website and mobile application (together, the "Platform"). By using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.
1. Who we are
"KaliWealth" is a brand and trade name. The Platform and the distribution services offered through it are provided by Shreyas Kali, an individual registered with the Association of Mutual Funds in India (AMFI) as a Mutual Fund Distributor bearing ARN-301185 (registration held on an individual basis). In these Terms, "KaliWealth", "we", "us", and "our" refer to this individual distributor operating under the KaliWealth brand.
We distribute mutual funds and other permitted financial products and provide goal-based planning and behavioural coaching support. We are not a Portfolio Manager, and we are not a SEBI-Registered Investment Adviser unless expressly stated.
2. Eligibility
You must be at least 18 years of age, a resident of India (unless we expressly support your category), and legally capable of entering into a binding contract. You agree to provide accurate, current, and complete information and to keep it updated.
3. Nature of our service
- We facilitate the distribution of mutual funds and other products you choose. The decision to invest, hold, or redeem is yours.
- Our snapshot, plans, nudges, and coaching are intended to support disciplined investing and do not constitute a guarantee of any outcome.
- We earn commissions from AMCs on Regular Plans you transact through us, as disclosed in our AMFI Disclosures.
4. No guaranteed returns
Investments in mutual funds and securities markets are subject to market risks. The value of investments can go up or down. Past performance is not indicative of future results. Nothing on the Platform should be construed as a promise or guarantee of returns.
5. Your responsibilities
- Keep your login credentials confidential and notify us of any unauthorised use.
- Use the Platform only for lawful purposes and not to infringe the rights of others.
- Ensure that funds used for investment are from legitimate sources and comply with applicable laws.
6. Intellectual property
All content, trademarks, logos, and software on the Platform are owned by or licensed to KaliWealth and are protected by applicable laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.
7. Third-party services
The Platform may rely on or link to third-party services (such as KYC, payment, and AMC systems). We are not responsible for the content or practices of third parties, and your use of those services may be subject to their own terms.
8. Limitation of liability
To the maximum extent permitted by law, KaliWealth shall not be liable for any indirect, incidental, or consequential losses, or for investment losses arising from market movements or from decisions you make using the Platform.
9. Suspension and termination
We may suspend or terminate access to the Platform if you breach these Terms or where required for legal, security, or regulatory reasons. You may stop using the Platform at any time, subject to settlement of any pending transactions.
10. Governing law
These Terms are governed by the laws of India. Any disputes are subject to the exclusive jurisdiction of the courts at [city], India.
